Two boundary problems are open at the top level. Courts sit in both the legal and political domains, assigned by whether the question is about rule validity or the allocation of authority. Religious law sits in both the religious and legal domains, split by whether the state enforces it. Neither split is settled.

Cranial nerves are placed in the peripheral nervous system on anatomical grounds. CN I and CN II are histologically central nervous tissue, and CN II is a tract of the diencephalon rather than a peripheral nerve. Placing them peripherally makes the division fail on histological criteria while passing on anatomical ones, which means the division is only mutually exclusive once it is fixed which criterion governs.

The bound was adopted so that a complete division can be held in working memory at once, and nine defeats that. The division also excludes hormonal signalling to an endocrine system that does not appear among the nine, so the set is simultaneously over the ceiling and incomplete.
